# Missouri v. Frye

## Holding used

Counsel must communicate formal favorable offers; prejudice for a lost offer requires probable acceptance, entry without cancellation or refusal, and a more favorable outcome.

## Material limitation

There is no constitutional right to receive an offer, and the offer's form, terms, lapse, communication, response, and actor discretion must be proved.
