Eleventh Circuit Overlay
This page prevents nationwide rules from being mistaken for Eleventh Circuit doctrine and prevents unresearched circuit law from being guessed. It is a bounded overlay, not an exhaustive treatise or a substitute for the current docket, published opinions, local rules, or citator.

Verified circuit holdings
- CLM-CIR11-001: The Eleventh Circuit holds that § 2241 administrative exhaustion is not jurisdictional; it remains a requirement that a court ordinarily enforces when the respondent properly asserts it, but the court need not raise it sua sponte. Santiago-Lugo v. Warden, 785 F.3d 467, 474–75 (11th Cir. 2015)
Limitation: Binding only in the Eleventh Circuit. The opinion does not create a nationwide exception or excuse, and a claim-specific statutory exhaustion provision may require separate analysis.
- CLM-CIR11-002: The Eleventh Circuit reviews denial of § 3583(e) modification or early termination for abuse of discretion and requires the order or record to show enough consideration of the relevant statutory factors to permit meaningful appellate review, without a ritual statement of every factor. United States v. Cordero, 7 F.4th 1058, 1069–71 (11th Cir. 2021)
Limitation: Binding only in the Eleventh Circuit; the adequacy of a particular record remains case specific and the relevant § 3553(a) subset is supplied by § 3583(e).
- CLM-CIR11-003: The Eleventh Circuit holds that § 3583(e)(2) is not a vehicle for a collateral attack on the original legality or constitutionality of an imposed supervised-release condition; the opinion identifies direct appeal or § 2255 as the ordinary channels for such an attack. United States v. Cordero, 7 F.4th 1058, 1066–68 (11th Cir. 2021)
Limitation: Binding only in the Eleventh Circuit and limited to collateral attacks on the condition as originally imposed; later changed facts and permissible modification grounds require separate analysis.
- CLM-CIR11-004: In the Eleventh Circuit, denial of an eligible § 404 motion is reviewed for abuse of discretion; a court may deny relief even when the existing sentence exceeds the revised statutory maximum, may not use § 404 as a collateral vehicle to invalidate the original sentence, and may satisfy Concepcion with a brief explanation evident from the record. United States v. Williams, 63 F.4th 908, 912–14 (11th Cir. 2023)
Limitation: Binding only in the Eleventh Circuit. Williams does not permit a court to ignore nonfrivolous arguments, require a reduction, or decide an independent collateral attack through § 404.
- CLM-CIR11-005: In the Eleventh Circuit, a federal prisoner proceeding under § 2241 does not need a certificate of appealability because § 2253(c)(1)(B) reaches § 2255 proceedings, not federal-process § 2241 proceedings. Sawyer v. Holder, 326 F.3d 1363, 1364 n.3 (11th Cir. 2003)
Limitation: Binding only in the Eleventh Circuit and limited to the COA question. Sawyer's saving-clause merits analysis is not adopted and must be read in light of later Supreme Court law; state-process custody and filing classification remain separate.
- CLM-CIR11-006: In the Eleventh Circuit, § 3582(c)(1)(A)'s defendant-filing prerequisite is a nonjurisdictional claim-processing rule; when the government does not assert noncompliance, the court may reach the merits rather than raise the prerequisite on its own. United States v. Harris, 989 F.3d 908, 910–12 (11th Cir. 2021)
Limitation: Binding only in the Eleventh Circuit. Harris did not decide whether the filing rule is mandatory when invoked and its pandemic-specific merits analysis is not adopted as current law.
- CLM-CIR11-007: In the Eleventh Circuit, audita querela may not be granted when the challenge is cognizable under § 2255; after recharacterization, an unauthorized second or successive motion remains outside the district court's jurisdiction. United States v. Holt, 417 F.3d 1172, 1174–75 (11th Cir. 2005) (per curiam)
Limitation: Binding only in the Eleventh Circuit. Holt did not hold that audita querela survives for claims outside § 2255; it addressed a constitutional sentencing attack by a prisoner with a prior § 2255 motion and an absent successive-motion authorization.
Circuit-sensitive issue register
Each row records the nationwide floor, the circuit rule actually verified or the exact missing source, intra-circuit conflict status, publication status, relevant local-rule source, inter-circuit comparison, current-split status, and the check date. “Not verified” is a stop condition, not an invitation to infer the rule.
| Issue | Supreme Court or nationwide floor | Eleventh Circuit rule | Intra-circuit conflict | Publication status | Relevant local rule | Conflicting circuits / current split | Last checked |
|---|---|---|---|---|---|---|---|
| § 2241 administrative exhaustion | Section 2241 contains no general exhaustion clause; 28 C.F.R. part 542 defines the BOP remedy path. The character, waiver, and exceptions require controlling circuit law. | Santiago-Lugo v. Warden, 785 F.3d 467, 473–75 (11th Cir. 2015): nonjurisdictional, ordinarily enforced when properly asserted, and not raised sua sponte. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | Official Eleventh Circuit rules source; no issue-specific local-rule absence is asserted. | Ninth Circuit also treats the requirement as nonjurisdictional but describes prudential waiver for futility; no exhaustive current split survey is claimed. | 2026-08-25 |
| COA for a federal § 2241 appeal | Section 2253(c) identifies the proceedings for which a COA is required; custody source and proceeding classification control. | Sawyer v. Holder, 326 F.3d 1363, 1364 n.3 (11th Cir. 2003): a federal prisoner proceeding under § 2241 does not need a COA. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | Official Eleventh Circuit rules source; no issue-specific local-rule absence is asserted. | Only the COA proposition is adopted; later Supreme Court law controls saving-clause merits. | 2026-08-25 |
| First Step Act § 404 procedure and review | Concepcion and § 404 supply the nationwide floor, but hearing, presence, explanation, preservation, and review rules may require circuit authority. | United States v. Williams, 63 F.4th 908, 912–14 (11th Cir. 2023): abuse-of-discretion review; no compelled reduction above the revised maximum; no collateral attack through § 404; a brief record-based explanation may suffice. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | Official Eleventh Circuit rules source; no issue-specific local-rule absence is asserted. | Nonfrivolous arguments still must be considered; no reduction is guaranteed. | 2026-08-25 |
| § 3582 issue presentation, reconsideration, and appeal | Section 3582(c), Rule 43, and Appellate Rule 4 supply text; issue exhaustion, reconsideration, waiver, and remedy remain posture- and circuit-sensitive. | United States v. Harris, 989 F.3d 908, 910–12 (11th Cir. 2021): nonjurisdictional claim-processing rule; when the government did not invoke it, the court reached the merits. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | Official Eleventh Circuit rules source; no issue-specific local-rule absence is asserted. | Harris did not decide whether the rule is mandatory when invoked, and its pandemic merits analysis is not adopted. | 2026-08-25 |
| § 3583(e) modification and early termination | Section 3583(e) supplies eligibility, factors, and authorized actions; explanation, changed-circumstance, hearing, review, and collateral-attack rules may differ by circuit. | United States v. Cordero, 7 F.4th 1058, 1066–71 (11th Cir. 2021): abuse-of-discretion review, reviewable factor record, and no collateral attack through § 3583(e)(2). | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | Official Eleventh Circuit rules source; no issue-specific local-rule absence is asserted. | No exhaustive inter-circuit survey completed; changed-circumstances and hearing questions remain issue specific. | 2026-08-25 |
| Audita querela and other residual writs | The All Writs Act and Supreme Court limits supply the nationwide floor; any surviving elements test and remedial gap require current circuit authority. | United States v. Holt, 417 F.3d 1172, 1174–75 (11th Cir. 2005): no audita querela when the claim is cognizable under § 2255; an unauthorized successive motion remains jurisdictionally barred after recharacterization. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | Official Eleventh Circuit rules source; no issue-specific local-rule absence is asserted. | Holt does not decide whether the writ survives outside § 2255's field. | 2026-08-26 |
Application controls
- Classify the judgment, custody source, motion, court, requested relief, and appellate posture before selecting an overlay row.
- Use only a verified published circuit holding for a circuit proposition; do not promote a district opinion, unpublished disposition, dicta, or a party's characterization into binding law.
- Run a current citator and check en banc, Supreme Court, statutory, rule, and local-rule changes before filing.
- Preserve issue presentation, objections, the operative record, deadline trigger, and the governing standard of review.
- If the issue register says
not_verified, use the linked nationwide module only for its bounded nationwide proposition and obtain the missing controlling authority.
