# Fifth Circuit Overlay

This page prevents nationwide rules from being mistaken for Fifth Circuit doctrine and prevents unresearched circuit law from being guessed. It is a bounded overlay, not an exhaustive treatise or a substitute for the current docket, published opinions, local rules, or citator.

## Official rule source and currency

- [Official Fifth Circuit rules and procedures](https://www.ca5.uscourts.gov/rules-procedures)
- Official rules-and-procedures repository checked on 2026-08-25; issue-specific current text must be opened before use.
- Source authority: `AUTH-CA5-LOCAL-RULES`.
- A portal check does not prove that no issue-specific local rule exists. Open the current rule, amendments, internal operating procedures, and standing orders for the actual filing.

## Verified circuit holdings

<!-- claim:CLM-CIR5-001 authorities:AUTH-CA5-FULLER-11-F3D-61 status:verified_current -->
- **CLM-CIR5-001:** In the Fifth Circuit, a federal prisoner challenging a Parole Commission decision ordinarily must exhaust before § 2241 review; an exception requires extraordinary circumstances such as an unavailable or wholly inappropriate remedy or a patently futile course, and the prisoner bears the burden. [*Fuller v. Rich*, 11 F.3d 61, 62 (5th Cir. 1994)](https://www.ca5.uscourts.gov/Opinions/pub/93/93-01767.CR0.wpd.pdf)

  Limitation: Binding only in the Fifth Circuit and limited to a Parole Commission administrative appeal. The opinion required presentation even when the appeal might be rejected as untimely and does not excuse BOP Part 542 exhaustion on speculation alone.
<!-- claim:CLM-CIR5-002 authorities:AUTH-PL-115-391-SEC-404,AUTH-SCOTUS-CONCEPCION-597-US-481,AUTH-CA5-NARANJO-102-F4TH-280 status:verified_current -->
- **CLM-CIR5-002:** In the Fifth Circuit, § 404(c)'s bar on a later motion after a prior merits denial is a mandatory claim-processing rule rather than a jurisdictional limit; when the government properly invokes the bar and the first motion received a complete merits review, the court must enforce it. [*United States v. Naranjo*, 102 F.4th 280, 283–85 (5th Cir. 2024)](https://www.ca5.uscourts.gov/opinions/pub/22/22-50938-CV0.pdf)

  Limitation: Binding only in the Fifth Circuit and limited to § 404(c)'s successive-motion bar. Naranjo does not resolve hearing rights, the merits of an initial motion, or whether a materially different prior disposition was a complete merits review.
<!-- claim:CLM-CIR5-003 authorities:AUTH-USC-28-2253,AUTH-CA5-JEFFERS-253-F3D-827 status:verified_current -->
- **CLM-CIR5-003:** In the Fifth Circuit, a federal prisoner proceeding under § 2241 does not need a certificate of appealability to appeal the denial of the petition. [*Jeffers v. Chandler*, 253 F.3d 827, 830 (5th Cir. 2001) (per curiam)](https://www.ca5.uscourts.gov/Opinions/pub/99/99-41461.cv0.wpd.pdf)

  Limitation: Binding only in the Fifth Circuit and limited to the COA rule after correct § 2241 classification. Jeffers's saving-clause merits analysis is not adopted and must be read in light of later Supreme Court law.
<!-- claim:CLM-CIR5-004 authorities:AUTH-USC-18-3582-3583,AUTH-CA5-FRANCO-973-F3D-465 status:verified_current -->
- **CLM-CIR5-004:** In the Fifth Circuit, § 3582(c)(1)(A)'s defendant-filing prerequisite is a nonjurisdictional but mandatory claim-processing rule: both statutory routes begin with a request to BOP, and a court must enforce the rule when the government properly raises it. [*United States v. Franco*, 973 F.3d 465, 467–69 (5th Cir. 2020)](https://www.ca5.uscourts.gov/opinions/pub/20/20-60473-CR0.pdf)

  Limitation: Binding only in the Fifth Circuit. Franco involved a defendant who made no BOP request before filing and does not decide issue exhaustion after a qualifying request or the merits of relief.
<!-- claim:CLM-CIR5-005 authorities:AUTH-USC-18-3582-3583,AUTH-CA5-CAILLIER-79-F4TH-506 status:verified_current -->
- **CLM-CIR5-005:** In the Fifth Circuit, changed circumstances are not a jurisdictional prerequisite to modifying a supervised-release condition under § 3583(e)(2), but illegality alone is not one of the enumerated grounds and cannot itself supply the basis for modification. [*United States v. Caillier*, 79 F.4th 506, 509–12 (5th Cir. 2023)](https://www.ca5.uscourts.gov/opinions/pub/22/22-30383-CR0.pdf)

  Limitation: Binding only in the Fifth Circuit. Caillier permits modification for statutory reasons such as deterrence and public safety even when an invalid original condition prompted review; it does not allow § 3583(e)(2) to replace direct or collateral review of legality.
<!-- claim:CLM-CIR5-006 authorities:AUTH-USC-28-1651,AUTH-CA5-MILLER-599-F3D-484 status:verified_current -->
- **CLM-CIR5-006:** In the Fifth Circuit, assuming audita querela survives in criminal cases, it is limited to a postjudgment legal objection unavailable through another postconviction remedy; purely equitable grounds are insufficient. [*United States v. Miller*, 599 F.3d 484, 488–90 (5th Cir. 2010)](https://cases.justia.com/federal/appellate-courts/ca5/08-11186/920100308/0.pdf)

  Limitation: Binding only in the Fifth Circuit. Miller left survival of the writ open and arose from a restitution-offset request; its actual disposition does not establish that AEDPA limits, nonretroactivity, or hardship alone creates a gap.

## Circuit-sensitive issue register

Each row records the nationwide floor, the circuit rule actually verified or the exact missing source, intra-circuit conflict status, publication status, relevant local-rule source, inter-circuit comparison, current-split status, and the check date. “Not verified” is a stop condition, not an invitation to infer the rule.

| Issue | Supreme Court or nationwide floor | Fifth Circuit rule | Intra-circuit conflict | Publication status | Relevant local rule | Conflicting circuits / current split | Last checked |
|---|---|---|---|---|---|---|---|
| § 2241 administrative exhaustion | Section 2241 contains no general exhaustion clause; 28 C.F.R. part 542 defines the BOP remedy path. The character, waiver, and exceptions require controlling circuit law. | *Fuller v. Rich*, 11 F.3d 61, 62 (5th Cir. 1994): Parole Commission exhaustion is required; exceptions demand extraordinary circumstances and the prisoner bears the burden. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Fifth Circuit rules source](https://www.ca5.uscourts.gov/rules-procedures); no issue-specific local-rule absence is asserted. | Parole Commission posture; no automatic application to a materially different BOP process is claimed. | 2026-08-25 |
| COA for a federal § 2241 appeal | Section 2253(c) identifies the proceedings for which a COA is required; custody source and proceeding classification control. | *Jeffers v. Chandler*, 253 F.3d 827, 830 (5th Cir. 2001) (per curiam): a federal prisoner proceeding under § 2241 does not need a COA. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Fifth Circuit rules source](https://www.ca5.uscourts.gov/rules-procedures); no issue-specific local-rule absence is asserted. | Only the COA proposition is adopted; later Supreme Court law controls saving-clause merits. | 2026-08-25 |
| First Step Act § 404 procedure and review | Concepcion and § 404 supply the nationwide floor, but hearing, presence, explanation, preservation, and review rules may require circuit authority. | *United States v. Naranjo*, 102 F.4th 280, 283–85 (5th Cir. 2024): § 404(c)'s successive-motion bar is mandatory claim processing, not jurisdictional, and must be enforced when properly invoked after a complete prior merits review. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Fifth Circuit rules source](https://www.ca5.uscourts.gov/rules-procedures); no issue-specific local-rule absence is asserted. | Narrow § 404(c) classification only; other procedure and review questions remain distinct. | 2026-08-25 |
| § 3582 issue presentation, reconsideration, and appeal | Section 3582(c), Rule 43, and Appellate Rule 4 supply text; issue exhaustion, reconsideration, waiver, and remedy remain posture- and circuit-sensitive. | *United States v. Franco*, 973 F.3d 465, 467–69 (5th Cir. 2020): nonjurisdictional but mandatory; both routes begin with a BOP request and the court must enforce the rule when properly raised. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Fifth Circuit rules source](https://www.ca5.uscourts.gov/rules-procedures); no issue-specific local-rule absence is asserted. | No issue-exhaustion proposition is inferred; Franco involved no BOP request at all. | 2026-08-25 |
| § 3583(e) modification and early termination | Section 3583(e) supplies eligibility, factors, and authorized actions; explanation, changed-circumstance, hearing, review, and collateral-attack rules may differ by circuit. | *United States v. Caillier*, 79 F.4th 506, 509–12 (5th Cir. 2023): changed circumstances are not jurisdictionally required for condition modification, but illegality alone is not an enumerated modification ground. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Fifth Circuit rules source](https://www.ca5.uscourts.gov/rules-procedures); no issue-specific local-rule absence is asserted. | A statutory purpose such as deterrence or public safety may support modification even when an invalid condition prompted review; legality review remains separate. | 2026-08-25 |
| Audita querela and other residual writs | The All Writs Act and Supreme Court limits supply the nationwide floor; any surviving elements test and remedial gap require current circuit authority. | *United States v. Miller*, 599 F.3d 484, 488–90 (5th Cir. 2010): if the writ survives, it requires a later legal objection unavailable through another remedy; pure equity is insufficient. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Fifth Circuit rules source](https://www.ca5.uscourts.gov/rules-procedures); no issue-specific local-rule absence is asserted. | Miller's restitution posture does not make AEDPA limits, nonretroactivity, or hardship a remedial gap. | 2026-08-26 |

## Application controls

1. Classify the judgment, custody source, motion, court, requested relief, and appellate posture before selecting an overlay row.
2. Use only a verified published circuit holding for a circuit proposition; do not promote a district opinion, unpublished disposition, dicta, or a party's characterization into binding law.
3. Run a current citator and check en banc, Supreme Court, statutory, rule, and local-rule changes before filing.
4. Preserve issue presentation, objections, the operative record, deadline trigger, and the governing standard of review.
5. If the issue register says `not_verified`, use the linked nationwide module only for its bounded nationwide proposition and obtain the missing controlling authority.
