# Second Circuit Overlay

This page prevents nationwide rules from being mistaken for Second Circuit doctrine and prevents unresearched circuit law from being guessed. It is a bounded overlay, not an exhaustive treatise or a substitute for the current docket, published opinions, local rules, or citator.

## Official rule source and currency

- [Official Second Circuit rules and procedures](https://www.ca2.uscourts.gov/clerk/case_filing/rules/rules_home.html)
- Official rules repository checked on 2026-08-25; issue-specific current text must be opened before use.
- Source authority: `AUTH-CA2-LOCAL-RULES`.
- A portal check does not prove that no issue-specific local rule exists. Open the current rule, amendments, internal operating procedures, and standing orders for the actual filing.

## Verified circuit holdings

<!-- claim:CLM-CIR2-001 authorities:AUTH-CA2-CARMONA-243-F3D-629 status:verified_current -->
- **CLM-CIR2-001:** In the Second Circuit, federal prisoners ordinarily must exhaust BOP remedies before § 2241 review; when a prisoner procedurally defaults and the administrative path has closed, review is barred unless cause and prejudice are shown. [*Carmona v. U.S. Bureau of Prisons*, 243 F.3d 629, 633–34 (2d Cir. 2001)](https://www.courtlistener.com/opinion/772485/carlos-pelaez-edison-carmona-v-united-states-bureau-of-prisons/)

  Limitation: Binding only in the Second Circuit and limited to a federal disciplinary proceeding and procedural default. Legitimate circumstances beyond the prisoner's control may supply cause, but this claim does not define every excuse from ordinary exhaustion.
<!-- claim:CLM-CIR2-002 authorities:AUTH-PL-115-391-SEC-404,AUTH-SCOTUS-CONCEPCION-597-US-481,AUTH-CA2-GADSDEN-982-F3D-106 status:verified_current -->
- **CLM-CIR2-002:** In the Second Circuit, a district court is not categorically required to hold a hearing at which the defendant is present before denying a First Step Act § 404 sentence-reduction motion. [*United States v. Gadsden*, 982 F.3d 106, 112–15 (2d Cir. 2020)](https://www.govinfo.gov/content/pkg/USCOURTS-ca2-19-03139/pdf/USCOURTS-ca2-19-03139-0.pdf)

  Limitation: Binding only in the Second Circuit and limited to the absence of a categorical hearing-and-presence requirement before denial. Gadsden does not prohibit a hearing, resolve every due-process question, or excuse compliance with Concepcion's later nationwide explanation rule.
<!-- claim:CLM-CIR2-003 authorities:AUTH-USC-28-2253,AUTH-CA2-DRAX-338-F3D-98 status:verified_current -->
- **CLM-CIR2-003:** In the Second Circuit, § 2253(c)'s certificate-of-appealability requirement does not apply to a federal habeas proceeding under § 2241. [*Drax v. Reno*, 338 F.3d 98, 106 n.12 (2d Cir. 2003)](https://www.courtlistener.com/opinion/782936/drax-v-reno/)

  Limitation: Binding only in the Second Circuit. Drax arose from federal immigration detention; the proposition does not address state-process detention, § 2255 proceedings, or whether a filing is correctly classified under § 2241.
<!-- claim:CLM-CIR2-004 authorities:AUTH-USC-18-3582-3583,AUTH-CA2-SALADINO-7-F4TH-120 status:verified_current -->
- **CLM-CIR2-004:** In the Second Circuit, § 3582(c)(1)(A)'s defendant-filing prerequisite is a nonjurisdictional claim-processing rule that the government may waive or forfeit; after the government withdrew the defense, the district court could consider the motion even if the defendant had not satisfied the prerequisite. [*United States v. Saladino*, 7 F.4th 120, 121–24 (2d Cir. 2021)](https://storage.courtlistener.com/pdf/2021/08/04/united_states_v._saladino.pdf)

  Limitation: Binding only in the Second Circuit. The panel did not decide which of two competing readings of the 30-day route was correct; the separate concurrence's equitable-exception analysis is not attributed to the court.
<!-- claim:CLM-CIR2-005 authorities:AUTH-USC-18-3582-3583,AUTH-CA2-GAMMARANO-321-F3D-311 status:verified_current -->
- **CLM-CIR2-005:** In the Second Circuit, a court deciding whether to modify or terminate supervised release must consider the § 3583(e) subset of § 3553(a) factors, but it need not make a separate factual finding on each factor; a statement, read with the record, that the statutory factors were considered is sufficient. [*United States v. Gammarano*, 321 F.3d 311, 315–16 (2d Cir. 2003)](https://www.courtlistener.com/opinion/781046/united-states-v-john-gammarano/)

  Limitation: Binding only in the Second Circuit. Gammarano does not require a particular explanation length, create a presumption of termination, or decide whether changed circumstances are required for condition modification; Parisi separately clarifies that they are not.
<!-- claim:CLM-CIR2-006 authorities:AUTH-USC-28-1651,AUTH-CA2-RICHTER-510-F3D-103 status:verified_current -->
- **CLM-CIR2-006:** In the Second Circuit, audita querela supplies at most a hypothetical avenue when the complete absence of collateral review would raise serious constitutional questions; a nonretroactive Booker claim did not create that circumstance or a remedial gap. [*United States v. Richter*, 510 F.3d 103, 104 (2d Cir. 2007)](https://cases.justia.com/federal/appellate-courts/ca2/06-1930/920071204/0.pdf)

  Limitation: Binding only in the Second Circuit. Richter did not hold that the writ lies in any actual case, did not make statutory nonretroactivity a constitutional defect, and predates Jones v. Hendrix; no post-Jones expansion or exception is inferred.

## Circuit-sensitive issue register

Each row records the nationwide floor, the circuit rule actually verified or the exact missing source, intra-circuit conflict status, publication status, relevant local-rule source, inter-circuit comparison, current-split status, and the check date. “Not verified” is a stop condition, not an invitation to infer the rule.

| Issue | Supreme Court or nationwide floor | Second Circuit rule | Intra-circuit conflict | Publication status | Relevant local rule | Conflicting circuits / current split | Last checked |
|---|---|---|---|---|---|---|---|
| § 2241 administrative exhaustion | Section 2241 contains no general exhaustion clause; 28 C.F.R. part 542 defines the BOP remedy path. The character, waiver, and exceptions require controlling circuit law. | *Carmona v. U.S. Bureau of Prisons*, 243 F.3d 629, 633–34 (2d Cir. 2001): ordinary exhaustion is required; a closed administrative path caused by procedural default requires cause and prejudice. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Second Circuit rules source](https://www.ca2.uscourts.gov/clerk/case_filing/rules/rules_home.html); no issue-specific local-rule absence is asserted. | Cause-and-prejudice rule addresses procedural default, not every prospective excuse from exhaustion. | 2026-08-25 |
| COA for a federal § 2241 appeal | Section 2253(c) identifies the proceedings for which a COA is required; custody source and proceeding classification control. | *Drax v. Reno*, 338 F.3d 98, 106 n.12 (2d Cir. 2003): § 2253(c) does not apply to a federal § 2241 habeas proceeding. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Second Circuit rules source](https://www.ca2.uscourts.gov/clerk/case_filing/rules/rules_home.html); no issue-specific local-rule absence is asserted. | Federal immigration-detention posture; no state-process, § 2255, or classification rule is inferred. | 2026-08-25 |
| First Step Act § 404 procedure and review | Concepcion and § 404 supply the nationwide floor, but hearing, presence, explanation, preservation, and review rules may require circuit authority. | *United States v. Gadsden*, 982 F.3d 106, 112–15 (2d Cir. 2020): no categorical requirement for a hearing at which the defendant is present before denial of a § 404 motion. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Second Circuit rules source](https://www.ca2.uscourts.gov/clerk/case_filing/rules/rules_home.html); no issue-specific local-rule absence is asserted. | Only the no-categorical-hearing proposition is adopted; Concepcion controls later explanation and intervening-information questions. | 2026-08-25 |
| § 3582 issue presentation, reconsideration, and appeal | Section 3582(c), Rule 43, and Appellate Rule 4 supply text; issue exhaustion, reconsideration, waiver, and remedy remain posture- and circuit-sensitive. | *United States v. Saladino*, 7 F.4th 120, 121–24 (2d Cir. 2021): nonjurisdictional claim-processing rule, waivable or forfeitable by the government. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Second Circuit rules source](https://www.ca2.uscourts.gov/clerk/case_filing/rules/rules_home.html); no issue-specific local-rule absence is asserted. | The panel did not choose between competing readings of the 30-day route; the concurrence's equitable-exception analysis is not a panel holding. | 2026-08-25 |
| § 3583(e) modification and early termination | Section 3583(e) supplies eligibility, factors, and authorized actions; explanation, changed-circumstance, hearing, review, and collateral-attack rules may differ by circuit. | *United States v. Gammarano*, 321 F.3d 311, 315–16 (2d Cir. 2003): consider the listed factors, but no factor-by-factor findings are required when the record shows consideration. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Second Circuit rules source](https://www.ca2.uscourts.gov/clerk/case_filing/rules/rules_home.html); no issue-specific local-rule absence is asserted. | No fixed explanation length or presumption of termination; condition-modification changed-circumstance doctrine is separate. | 2026-08-25 |
| Audita querela and other residual writs | The All Writs Act and Supreme Court limits supply the nationwide floor; any surviving elements test and remedial gap require current circuit authority. | *United States v. Richter*, 510 F.3d 103, 104 (2d Cir. 2007): only a serious constitutional problem caused by the total absence of collateral review could potentially support the writ; Booker nonretroactivity did not. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Second Circuit rules source](https://www.ca2.uscourts.gov/clerk/case_filing/rules/rules_home.html); no issue-specific local-rule absence is asserted. | No actual case granting the writ is established, and no post-Jones expansion is inferred. | 2026-08-26 |

## Application controls

1. Classify the judgment, custody source, motion, court, requested relief, and appellate posture before selecting an overlay row.
2. Use only a verified published circuit holding for a circuit proposition; do not promote a district opinion, unpublished disposition, dicta, or a party's characterization into binding law.
3. Run a current citator and check en banc, Supreme Court, statutory, rule, and local-rule changes before filing.
4. Preserve issue presentation, objections, the operative record, deadline trigger, and the governing standard of review.
5. If the issue register says `not_verified`, use the linked nationwide module only for its bounded nationwide proposition and obtain the missing controlling authority.
