# Seventh Circuit Overlay

This page prevents nationwide rules from being mistaken for Seventh Circuit doctrine and prevents unresearched circuit law from being guessed. It is a bounded overlay, not an exhaustive treatise or a substitute for the current docket, published opinions, local rules, or citator.

## Official rule source and currency

- [Official Seventh Circuit rules and procedures](https://www.ca7.uscourts.gov/assets/pdf/rules.pdf)
- Official rulebook dated December 1, 2025 checked on 2026-08-25.
- Source authority: `AUTH-CA7-LOCAL-RULES`.
- A portal check does not prove that no issue-specific local rule exists. Open the current rule, amendments, internal operating procedures, and standing orders for the actual filing.

## Verified circuit holdings

<!-- claim:CLM-CIR7-001 authorities:AUTH-CA7-RICHMOND-387-F3D-602 status:verified_current -->
- **CLM-CIR7-001:** The Seventh Circuit applies a common-law exhaustion rule to § 2241 even though the PLRA's statutory exhaustion rule does not apply; judge-made exceptions exist, but the hurdle is high and self-created delay does not establish an excuse. [*Richmond v. Scibana*, 387 F.3d 602, 604–06 (7th Cir. 2004)](https://www.courtlistener.com/opinion/788163/michael-richmond-v-joseph-scibana-warden-federal-correctional/)

  Limitation: Binding only in the Seventh Circuit. Richmond ultimately classified the placement-policy challenge outside § 2241, so the common-law exhaustion proposition must not be converted into a merits holding that every BOP placement challenge sounds in habeas.
<!-- claim:CLM-CIR7-002 authorities:AUTH-PL-115-391-SEC-404,AUTH-SCOTUS-CONCEPCION-597-US-481,AUTH-CA7-WILLIAMS-93-F4TH-389 status:verified_current -->
- **CLM-CIR7-002:** In the Seventh Circuit, the adequacy of a § 404 explanation is context dependent; a district court abuses its discretion when a materially changed record presents new nonfrivolous arguments and the ruling effectively repeats an earlier order without showing that those arguments were considered. [*United States v. Williams*, 93 F.4th 389, 391–94 (7th Cir. 2024)](https://media.ca7.uscourts.gov/cgi-bin/OpinionsWeb/processWebInputExternal.pl?Path=Y2024%2FD02-20%2FC%3A23-2313%3AJ%3AWood%3Aaut%3AT%3AfnOp%3AN%3A3170766%3AS%3A0&Submit=Display)

  Limitation: Binding only in the Seventh Circuit. Williams does not prescribe a required explanation length or guarantee relief; it addresses a current record materially different from the one underlying the earlier order.
<!-- claim:CLM-CIR7-003 authorities:AUTH-USC-28-2253,AUTH-CA7-WALKER-216-F3D-626 status:verified_current -->
- **CLM-CIR7-003:** In the Seventh Circuit, a federal prisoner properly proceeding under § 2241 does not need a certificate of appealability; for federal cases, § 2253(c) extends the COA requirement to § 2255 but not to § 2241. [*Walker v. O'Brien*, 216 F.3d 626, 638 (7th Cir. 2000)](https://www.courtlistener.com/opinion/769182/jimmy-walker-v-jt-obrien-and-joseph-w-finfrock-v-craig-a-hanks/)

  Limitation: Binding only in the Seventh Circuit and limited to federal-process custody. Walker's separate treatment of state-prisoner petitions is not adopted as a nationwide rule, and proceeding classification remains a distinct inquiry.
<!-- claim:CLM-CIR7-004 authorities:AUTH-USC-18-3582-3583,AUTH-CA7-SANFORD-986-F3D-779 status:verified_current -->
- **CLM-CIR7-004:** In the Seventh Circuit, § 3582(c)(1)(A)'s defendant-filing prerequisite is an affirmative defense and a mandatory claim-processing rule: the government can forfeit it, but the court must enforce it when the government properly invokes it. [*United States v. Sanford*, 986 F.3d 779, 781–82 (7th Cir. 2021)](https://storage.courtlistener.com/pdf/2021/01/25/united_states_v._gregory_sanford.pdf)

  Limitation: Binding only in the Seventh Circuit. Sanford resolved a motion filed three days after the warden received the request and did not reach the merits or establish a general issue-exhaustion rule.
<!-- claim:CLM-CIR7-005 authorities:AUTH-USC-18-3582-3583,AUTH-CA7-LOWE-632-F3D-996 status:verified_current -->
- **CLM-CIR7-005:** In the Seventh Circuit, an early-termination ruling must give some indication that the district court considered the statutory factors; a blanket policy of waiting until only twelve months of supervision remain circumvents § 3583(e)(1)'s individualized process. [*United States v. Lowe*, 632 F.3d 996, 998–99 (7th Cir. 2011)](https://www.govinfo.gov/content/pkg/USCOURTS-ca7-10-02832/pdf/USCOURTS-ca7-10-02832-0.pdf)

  Limitation: Binding only in the Seventh Circuit. Lowe does not require findings on every factor or a hearing on every motion; it requires a reviewable indication of factor consideration and rejects the categorical timing policy used there.
<!-- claim:CLM-CIR7-006 authorities:AUTH-USC-28-1651,AUTH-CA7-JOHNSON-962-F2D-579 status:verified_current -->
- **CLM-CIR7-006:** In the Seventh Circuit, audita querela would require a legal defense or discharge arising after judgment; equity, harsh collateral consequences, or gross injustice alone does not satisfy that requirement. [*United States v. Johnson*, 962 F.2d 579, 581–83 (7th Cir. 1992)](https://www.courtlistener.com/opinion/582608/united-states-v-manapurath-eappen-johnson/)

  Limitation: Binding only in the Seventh Circuit. Johnson declined to decide the writ's ultimate survival and addressed a deportation consequence after conviction; no broader gap or § 2255-circumvention rule is inferred beyond the opinion's express limits.

## Circuit-sensitive issue register

Each row records the nationwide floor, the circuit rule actually verified or the exact missing source, intra-circuit conflict status, publication status, relevant local-rule source, inter-circuit comparison, current-split status, and the check date. “Not verified” is a stop condition, not an invitation to infer the rule.

| Issue | Supreme Court or nationwide floor | Seventh Circuit rule | Intra-circuit conflict | Publication status | Relevant local rule | Conflicting circuits / current split | Last checked |
|---|---|---|---|---|---|---|---|
| § 2241 administrative exhaustion | Section 2241 contains no general exhaustion clause; 28 C.F.R. part 542 defines the BOP remedy path. The character, waiver, and exceptions require controlling circuit law. | *Richmond v. Scibana*, 387 F.3d 602, 604–06 (7th Cir. 2004): common-law exhaustion applies to § 2241; exceptions exist but the hurdle is high and self-created delay is not enough. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Seventh Circuit rules source](https://www.ca7.uscourts.gov/assets/pdf/rules.pdf); no issue-specific local-rule absence is asserted. | Richmond ultimately classified the placement-policy claim outside § 2241; only its exhaustion rule is used. | 2026-08-25 |
| COA for a federal § 2241 appeal | Section 2253(c) identifies the proceedings for which a COA is required; custody source and proceeding classification control. | *Walker v. O'Brien*, 216 F.3d 626, 638 (7th Cir. 2000): a federal prisoner properly proceeding under § 2241 does not need a COA; for federal cases § 2253(c) reaches § 2255. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Seventh Circuit rules source](https://www.ca7.uscourts.gov/assets/pdf/rules.pdf); no issue-specific local-rule absence is asserted. | Walker's separate state-prisoner treatment is not generalized beyond the exact federal-process proposition. | 2026-08-25 |
| First Step Act § 404 procedure and review | Concepcion and § 404 supply the nationwide floor, but hearing, presence, explanation, preservation, and review rules may require circuit authority. | *United States v. Williams*, 93 F.4th 389, 391–94 (7th Cir. 2024): explanation is context dependent, but a materially changed record and new nonfrivolous arguments cannot be met by effectively repeating an earlier order without showing consideration. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Seventh Circuit rules source](https://www.ca7.uscourts.gov/assets/pdf/rules.pdf); no issue-specific local-rule absence is asserted. | No fixed explanation length or required reduction is adopted. | 2026-08-25 |
| § 3582 issue presentation, reconsideration, and appeal | Section 3582(c), Rule 43, and Appellate Rule 4 supply text; issue exhaustion, reconsideration, waiver, and remedy remain posture- and circuit-sensitive. | *United States v. Sanford*, 986 F.3d 779, 781–82 (7th Cir. 2021): affirmative defense and mandatory claim-processing rule; forfeitable if not invoked, but enforceable when properly raised. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Seventh Circuit rules source](https://www.ca7.uscourts.gov/assets/pdf/rules.pdf); no issue-specific local-rule absence is asserted. | Sanford involved a filing three days after the request and did not reach merits or issue exhaustion. | 2026-08-25 |
| § 3583(e) modification and early termination | Section 3583(e) supplies eligibility, factors, and authorized actions; explanation, changed-circumstance, hearing, review, and collateral-attack rules may differ by circuit. | *United States v. Lowe*, 632 F.3d 996, 998–99 (7th Cir. 2011): the record must indicate factor consideration, and a blanket final-twelve-month policy is impermissible. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Seventh Circuit rules source](https://www.ca7.uscourts.gov/assets/pdf/rules.pdf); no issue-specific local-rule absence is asserted. | No findings on every factor or categorical hearing requirement is inferred. | 2026-08-25 |
| Audita querela and other residual writs | The All Writs Act and Supreme Court limits supply the nationwide floor; any surviving elements test and remedial gap require current circuit authority. | *United States v. Johnson*, 962 F.2d 579, 581–83 (7th Cir. 1992): a later legal defense or discharge is required; equity, harsh consequences, or gross injustice alone is insufficient. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Seventh Circuit rules source](https://www.ca7.uscourts.gov/assets/pdf/rules.pdf); no issue-specific local-rule absence is asserted. | Johnson declined to decide ultimate survival and does not identify a broader remedial gap. | 2026-08-26 |

## Application controls

1. Classify the judgment, custody source, motion, court, requested relief, and appellate posture before selecting an overlay row.
2. Use only a verified published circuit holding for a circuit proposition; do not promote a district opinion, unpublished disposition, dicta, or a party's characterization into binding law.
3. Run a current citator and check en banc, Supreme Court, statutory, rule, and local-rule changes before filing.
4. Preserve issue presentation, objections, the operative record, deadline trigger, and the governing standard of review.
5. If the issue register says `not_verified`, use the linked nationwide module only for its bounded nationwide proposition and obtain the missing controlling authority.
