# Sixth Circuit Overlay

This page prevents nationwide rules from being mistaken for Sixth Circuit doctrine and prevents unresearched circuit law from being guessed. It is a bounded overlay, not an exhaustive treatise or a substitute for the current docket, published opinions, local rules, or citator.

## Official rule source and currency

- [Official Sixth Circuit rules and procedures](https://www.ca6.uscourts.gov/sites/ca6/files/documents/rules_procedures/Full%20Rules%20w%20FRAP_0.pdf)
- Official rulebook amended July 13, 2026 checked on 2026-08-25.
- Source authority: `AUTH-CA6-LOCAL-RULES`.
- A portal check does not prove that no issue-specific local rule exists. Open the current rule, amendments, internal operating procedures, and standing orders for the actual filing.

## Verified circuit holdings

<!-- claim:CLM-CIR6-001 authorities:AUTH-CA6-FAZZINI-473-F3D-229 status:verified_current -->
- **CLM-CIR6-001:** In the Sixth Circuit, federal prisoners ordinarily must exhaust before filing under § 2241, but the judge-made requirement may be excused where remedies are futile or cannot provide the relief sought, or where the administrator—not the prisoner—caused the failure; a missing final response does not automatically defeat exhaustion. [*Fazzini v. Northeast Ohio Correctional Center*, 473 F.3d 229, 231–36 (6th Cir. 2006)](https://www.courtlistener.com/opinion/796434/paul-fazzini-v-northeast-ohio-correctional-center-warden-united-states/)

  Limitation: Binding only in the Sixth Circuit and arising from a Parole Commission appeal. The opinion's treatment of what must be attached at pleading is distinct from whether a particular BOP Part 542 claim was properly exhausted.
<!-- claim:CLM-CIR6-002 authorities:AUTH-PL-115-391-SEC-404,AUTH-SCOTUS-CONCEPCION-597-US-481,AUTH-CA6-DOMENECH-63-F4TH-1078 status:verified_current -->
- **CLM-CIR6-002:** In the Sixth Circuit, the § 404 benchmark recalculation incorporates only the Fair Sentencing Act's retroactive changes; the court then may consider other relevant intervening information, must reason through nonfrivolous arguments, and must explain the decision adequately for abuse-of-discretion review. [*United States v. Domenech*, 63 F.4th 1078, 1083–86 (6th Cir. 2023)](https://www.opn.ca6.uscourts.gov/opinions.pdf/23a0059p-06.pdf)

  Limitation: Binding only in the Sixth Circuit. Domenech does not require the benchmark Guidelines range to absorb nonretroactive changes and does not require a reduction; reassignment on remand was tied to the repeated failures in that record.
<!-- claim:CLM-CIR6-003 authorities:AUTH-USC-28-2253,AUTH-CA6-WITHAM-355-F3D-501 status:verified_current -->
- **CLM-CIR6-003:** In the Sixth Circuit, no certificate of appealability is required for a § 2241 appeal when the detention arises from federal process; § 2253(c)(1)'s state-process and § 2255 categories remain controlling. [*Witham v. United States*, 355 F.3d 501, 504 (6th Cir. 2004)](https://www.opn.ca6.uscourts.gov/opinions.pdf/04a0016p-06.pdf)

  Limitation: Binding only in the Sixth Circuit. Witham involved federal court-martial process; the opinion does not eliminate a COA for state-process detention or § 2255 and does not decide whether a filing is correctly classified under § 2241.
<!-- claim:CLM-CIR6-004 authorities:AUTH-USC-18-3582-3583,AUTH-CA6-ALAM-960-F3D-831 status:verified_current -->
- **CLM-CIR6-004:** In the Sixth Circuit, § 3582(c)(1)(A)'s defendant-filing prerequisite is nonjurisdictional but mandatory when the government timely invokes it; courts may not create a pandemic or futility exception, and a prematurely filed motion is dismissed without prejudice. [*United States v. Alam*, 960 F.3d 831, 832–36 (6th Cir. 2020)](https://www.opn.ca6.uscourts.gov/opinions.pdf/20a0171p-06.pdf)

  Limitation: Binding only in the Sixth Circuit. Alam recognizes waiver or forfeiture of the nonjurisdictional rule but found neither because the government objected throughout; its pandemic discussion does not supply a current merits rule.
<!-- claim:CLM-CIR6-005 authorities:AUTH-USC-18-3582-3583,AUTH-CA6-HALE-2025 status:verified_current -->
- **CLM-CIR6-005:** In the Sixth Circuit, § 3583(e)(1) does not make exceptionally good behavior an absolute prerequisite to early termination; conduct and changed circumstances remain relevant within the statute's broader discretionary inquiry. [*United States v. Hale*, No. 24-5362, slip op. at 3–5 (6th Cir. Jan. 30, 2025)](https://www.opn.ca6.uscourts.gov/opinions.pdf/25a0022p-06.pdf)

  Limitation: Binding only in the Sixth Circuit. Hale rejects a categorical threshold and vacated for use of the wrong standard; it does not hold ordinary compliance sufficient or direct that termination be granted.

## Circuit-sensitive issue register

Each row records the nationwide floor, the circuit rule actually verified or the exact missing source, intra-circuit conflict status, publication status, relevant local-rule source, inter-circuit comparison, current-split status, and the check date. “Not verified” is a stop condition, not an invitation to infer the rule.

| Issue | Supreme Court or nationwide floor | Sixth Circuit rule | Intra-circuit conflict | Publication status | Relevant local rule | Conflicting circuits / current split | Last checked |
|---|---|---|---|---|---|---|---|
| § 2241 administrative exhaustion | Section 2241 contains no general exhaustion clause; 28 C.F.R. part 542 defines the BOP remedy path. The character, waiver, and exceptions require controlling circuit law. | *Fazzini v. Northeast Ohio Correctional Center*, 473 F.3d 229, 231–36 (6th Cir. 2006): ordinary exhaustion is required, with bounded futility, unavailable-relief, and administrator-caused-failure exceptions. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Sixth Circuit rules source](https://www.ca6.uscourts.gov/sites/ca6/files/documents/rules_procedures/Full%20Rules%20w%20FRAP_0.pdf); no issue-specific local-rule absence is asserted. | Parole Commission posture; pleading proof and actual completion of a BOP remedy remain distinct questions. | 2026-08-25 |
| COA for a federal § 2241 appeal | Section 2253(c) identifies the proceedings for which a COA is required; custody source and proceeding classification control. | *Witham v. United States*, 355 F.3d 501, 504 (6th Cir. 2004): no COA for a § 2241 appeal where detention arises from federal process. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Sixth Circuit rules source](https://www.ca6.uscourts.gov/sites/ca6/files/documents/rules_procedures/Full%20Rules%20w%20FRAP_0.pdf); no issue-specific local-rule absence is asserted. | Federal court-martial posture; the source of custody, not the § 2241 label alone, controls. | 2026-08-25 |
| First Step Act § 404 procedure and review | Concepcion and § 404 supply the nationwide floor, but hearing, presence, explanation, preservation, and review rules may require circuit authority. | *United States v. Domenech*, 63 F.4th 1078, 1083–86 (6th Cir. 2023): recalculate the benchmark only for Fair Sentencing Act changes, then consider relevant intervening information and explain the treatment of nonfrivolous arguments. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Sixth Circuit rules source](https://www.ca6.uscourts.gov/sites/ca6/files/documents/rules_procedures/Full%20Rules%20w%20FRAP_0.pdf); no issue-specific local-rule absence is asserted. | No reduction is required; reassignment on remand was record specific. | 2026-08-25 |
| § 3582 issue presentation, reconsideration, and appeal | Section 3582(c), Rule 43, and Appellate Rule 4 supply text; issue exhaustion, reconsideration, waiver, and remedy remain posture- and circuit-sensitive. | *United States v. Alam*, 960 F.3d 831, 832–36 (6th Cir. 2020): nonjurisdictional but mandatory when timely invoked; no pandemic or futility exception, and premature filing is dismissed without prejudice. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Sixth Circuit rules source](https://www.ca6.uscourts.gov/sites/ca6/files/documents/rules_procedures/Full%20Rules%20w%20FRAP_0.pdf); no issue-specific local-rule absence is asserted. | Waiver or forfeiture remains possible if the government does not preserve the defense; no pandemic-specific merits rule is adopted. | 2026-08-25 |
| § 3583(e) modification and early termination | Section 3583(e) supplies eligibility, factors, and authorized actions; explanation, changed-circumstance, hearing, review, and collateral-attack rules may differ by circuit. | *United States v. Hale*, No. 24-5362, slip op. at 3–5 (6th Cir. Jan. 30, 2025): exceptionally good behavior is not an absolute prerequisite to early termination. | No intra-circuit conflict established in this bounded review; absence is not asserted. | published precedential | [Official Sixth Circuit rules source](https://www.ca6.uscourts.gov/sites/ca6/files/documents/rules_procedures/Full%20Rules%20w%20FRAP_0.pdf); no issue-specific local-rule absence is asserted. | Ordinary compliance does not automatically warrant relief, and the panel prescribed no result on remand. | 2026-08-25 |
| Audita querela and other residual writs | The All Writs Act and Supreme Court limits supply the nationwide floor; any surviving elements test and remedial gap require current circuit authority. | Not verified: the only published Sixth Circuit panel opinion squarely granting audita-querela relief, Ejelonu, was vacated when rehearing en banc was granted and the appeal was later dismissed; no replacement published controlling rule was located. | No intra-circuit conflict established in this bounded review; absence is not asserted. | not_verified | [Official Sixth Circuit rules source](https://www.ca6.uscourts.gov/sites/ca6/files/documents/rules_procedures/Full%20Rules%20w%20FRAP_0.pdf); no issue-specific local-rule absence is asserted. | The vacated Ejelonu panel opinion has no precedential force, and later unpublished criminal dispositions are not substituted for published control. | 2026-08-26 |

## Application controls

1. Classify the judgment, custody source, motion, court, requested relief, and appellate posture before selecting an overlay row.
2. Use only a verified published circuit holding for a circuit proposition; do not promote a district opinion, unpublished disposition, dicta, or a party's characterization into binding law.
3. Run a current citator and check en banc, Supreme Court, statutory, rule, and local-rule changes before filing.
4. Preserve issue presentation, objections, the operative record, deadline trigger, and the governing standard of review.
5. If the issue register says `not_verified`, use the linked nationwide module only for its bounded nationwide proposition and obtain the missing controlling authority.
